Business/Corporate

DUI/Traffic Offenses

All traffic related offenses may have a direct impact on your driver’s license privilege and the cost of your automobile insurance. If you have been charged with a DUI or other serious traffic offense, you should consult an attorney to know what your rights are. If you have been convicted of a DUI and your license has been suspended, you have the right to file a petition in Circuit Court seeking to have your license reinstated at an earlier date than may otherwise be stated in your suspension notice. This is sometimes referred to as a "hardship license" reinstatement.

Contract Law

A contract is generally stated as an outward expression of an intent to be bound in some way. It is a promise or set of promises, for breach of which the law gives a remedy, or the performance of which the law in some way recognizes as a duty. The parties must be competent to contract and the subject matter must be proper, with consideration, and have a mutual agreement and obligation. Not all contracts have to be in writing to be enforceable, however, it is always better to reduce your agreement to a written contract.

Medical Malpractice

Medical malpractice is simply a term for negligence committed by a medical provider be it a physician, hospital, nursing home facility, or any other healthcare provider. The time frame allowed to make a claim against such medical provider is shorter than the time allowed for most other personal injury claims. Criminal Law

If you think about law being separated into two catergories, civil and criminal, criminal law is any act which the government has deemed contrary to the public good. A crime is usually defined as misdemeanor or felony. A misdemeanor is a crime, such as simple assault or shop lifting, that will carry a possible jail sentence less than one year and will be served in a local or county jail, as opposed to the state’s department of corrections facility. A felony offense is a crime which is punishable by imprisonment for more than a year, or possibly, death. Many states now have pretrial diversion programs which essentially allow a first offender who has committed a nonviolent crime to complete a period of probation, pay a fine, and perform other community service. If successfully completed, the offender will not have a criminal record.

Personal Injury

The law defines a tort as a private or civil wrong or injury resulting from a breach of a legal duty that causes harm or injury to an individual, which will give that individual a cause of action to bring a lawsuit against a defendant for the recovery of his injuries or damages. A typical example of a tort is an automobile accident where someone runs a traffic light and collides with your vehicle causing injuries to you. You should consult our firm before negotiating any settlement or signing any release. There is no consultation fee for a personal injury case.

Premises Liability

If you are lawfully on the premises of a business or individual and become injured due to some negligent act of that property owner, you may have grounds for recovery of your injuries or damages.

Products Liability

Products Liability is a claim for negligence against a manufacturer of a product which is defective in some form and that defect causes injuries to the consumer or user.

Wrongful Death

Any injury caused to a person, either intentionally or negligently, which results in the death of that person, is termed wrongful death and the survivors of the deceased have a statutory right to make a claim for the economic loss or loss of income, funeral expenses, and other damages suffered by the deceased.
